Terms and Conditions
These Terms and Conditions ("Terms") govern the use of the Nuvia Horoscope mobile application ("App"), provided by AI Catalyst, Lda., with registered office in Azeitão, Setúbal, Portugal, tax number (NIF) 518188639 ("we", "us", "Nuvia"). By creating an account or using the App, you accept these Terms. If you do not agree with them, do not use the App.
These Terms are available at any time inside the App and at /docs/terms. How we handle personal data is described separately in our Privacy Policy, which forms part of your agreement with us.
1. What the App does
Nuvia Horoscope calculates real astrological charts and has them interpreted by artificial intelligence. From your date, time and place of birth the App computes your birth chart — planetary positions, Ascendant, Midheaven, houses and aspects — using the Swiss Ephemeris, and the AI then writes an interpretation limited to those calculated facts. Within a reading you may also send follow-up messages in free text, up to the limit included with the service you bought.
- Free of charge, with no credits and no AI: your birth chart wheel, your Sun sign, your Moon, Ascendant, Midheaven and houses, and your planetary positions and aspects. The generic daily horoscope by sign and quick compatibility by sign are also free: they are written once for everyone and served from a shared cache.
- Paid with credits: Ask the Chart, Planet or placement in depth and Essential Birth Reading (1 credit each), Full synastry and Solar Return (2 credits each) and the Complete Birth Chart with PDF (3 credits).
- Available only with a subscription: My Day, The Week's Transits and personal alerts. These do not cost credits and cannot be bought with them.
- The chart is calculated on our server when the reading is created and stored with it, together with the versions of the ephemeris, the time-zone database and the calculation rules used, so reopening a reading later always shows exactly the same chart. The AI never calculates astronomy — it only interprets what the engine computed.
- Without a time and place of birth there is no Ascendant, no Midheaven and no houses. The App says so instead of guessing, and the readings that depend on them are unavailable until you provide them.
- To create your first reading you must have a name, a date of birth and a gender on your profile. These are sent, together with the subject you wrote and the conversation, to our AI provider so that the reading can be generated. See the Privacy Policy for the details, including the personal facts the AI stores about you between readings.
2. Entertainment only — this is not professional advice
Readings are produced for entertainment and self-reflection, and for nothing else. They do not constitute, and must never be treated as, medical, psychological, psychiatric, legal, financial, tax, insurance or any other kind of professional advice. The text is generated by a language model that predicts plausible wording; it has no knowledge of your circumstances beyond what you tell it, no way of verifying anything, and it is designed to produce statements that feel personally meaningful even when they are entirely general.
Do not use a reading to make decisions about your health, your money, your legal position, your relationships or your safety. If you need help, consult a qualified professional. If you are in crisis, contact your local emergency services.
3. Age
- The App is intended for people aged 16 or over. By using it, you confirm that you are at least 16.
- We do not currently verify age. We ask for a date of birth because the birth chart is calculated from it, and we check only that it is a valid, non-future date. We do not check it against any minimum age and we do not ask for identification.
- If we learn that an account belongs to someone under 16, we will delete it. A parent or guardian may ask us to delete a minor's account by writing to info@aicatalyst.dev.
4. Your account
- You may register with an email address and password, or sign in with Apple or Google. Each email address can hold only one account, and you may hold one account per person.
- You are responsible for the accuracy of what you enter and for keeping your password and your device secure. Tell us at info@aicatalyst.dev if you believe someone else has access to your account.
- You may delete your account at any time in the App's settings. Deletion is confirmed by a code sent to your email address and is then immediate and permanent — your readings, conversations, stored facts and credit history are erased and cannot be recovered by us or by you.
- After deletion we keep a record of your email address for the purposes described in clause 5 and clause 5A, and we keep some technical request records that are not linked to a live account. This is explained in the Privacy Policy.
- If you signed in with Apple, deleting your account also revokes our Apple sign-in authorisation.
5. Credits
Readings are paid for with credits. Credits are an in-app entitlement, not money.
- Cost of a reading: Ask the Chart — 1 credit; Planet or placement in depth — 1 credit; Essential Birth Reading — 1 credit; Full synastry — 2 credits; Solar Return — 2 credits; Complete Birth Chart with PDF — 3 credits.
- Credits are charged once, when the reading is created. Everything inside that consultation is then included: the initial interpretation and up to 20 follow-up questions on the same subject. Follow-up questions do not cost extra credits. Once the limit is reached the consultation closes; we never charge you again automatically, and starting a new one is an explicit choice you make.
- A consultation covers the subject it was bought for. Changing the subject, changing the person in a synastry or asking for a different Solar Return year is a new consultation, and costs credits again.
- Credits spent are not returned. A reading you abandon halfway through, or delete from your history, does not give credits back.
- A new account receives 5 free welcome credits. This offer is once per person: if you previously held an account with the same email address and deleted it, a new account created with that address starts with zero credits. To make this rule work we keep the email addresses of deleted accounts, as explained in the Privacy Policy. Free credits may be changed or withdrawn at any time and have no monetary value.
- 5A. Recommendations. You may give us the e-mail address of someone who does not use the App. We send that person one invitation, in your name. If they create an account with that address and make a purchase — a credit pack or a subscription — you receive 10 credits and they receive 10 credits on top of what they bought. A recommendation pays once, however much that person buys afterwards, and there is no limit on how many people you may recommend in total, though we accept only a few invitations per hour from each account, so that the feature cannot be used to test addresses in bulk. An address does not qualify if it already belongs to an account, if someone has already recommended it, if it previously belonged to an account that was deleted, or if it is your own. Credits awarded this way are granted by us for bringing someone to the App; they are not a transfer of anyone's credits, and clause 5's rule that credits cannot be transferred between accounts is unaffected. We may withhold or reverse these credits, and close the accounts involved, where a recommendation is not genuine — addresses you invented, addresses entered in bulk, or accounts created by you to recommend yourself.
- Credits do not expire while your account exists, whether you bought them in a pack or received them with a subscription. Credits from a cancelled subscription stay in your balance.
- Credits are not money. They are not electronic money, not a stored-value or payment instrument, not a security, and not a currency of any kind. They cannot be exchanged for cash, transferred to another person or account, sold, gifted or used anywhere outside the App, and they carry no value once your account is deleted.
6. Purchases and subscriptions
- We sell one-off credit packs of 10, 30 and 80 credits, and monthly subscriptions: Essential (30 credits per month), Plus (60 credits per month) and Premium (130 credits per month).
- Every subscription also unlocks the three subscriber-only services — My Day (one reading a day, with 5 questions), The Week's Transits (one reading a week, with 10 questions) and personal alerts (up to four events a month, with 10 questions each). They do not consume credits, and they stop working when the subscription ends.
- All payments are processed by Apple (App Store) or Google (Google Play), never by us. The store is your seller of record for the transaction, it sets the local price and currency, it charges your payment method and it issues your receipt. Your purchase is also subject to that store's own terms. We never see or store your card or payment details.
- Prices shown in the store include VAT or sales tax where applicable, at the rate the store applies to your country.
- Once the store confirms a purchase, the credits are added to your balance. Subscription credits are added once for each billing period. If the App is closed when a subscription renews, the credits are added when our provider notifies us, or the next time you open the App.
- Subscriptions renew automatically at the end of each period, at the then-current price, until cancelled.
7. Cancelling a subscription
A subscription cannot be cancelled inside the App, and deleting your Nuvia account does not cancel it. You must cancel it where you bought it:
- iPhone / iPad: Settings → your name → Subscriptions → Nuvia Horoscope → Cancel Subscription.
- Android: Google Play → your profile picture → Payments and subscriptions → Subscriptions → Nuvia Horoscope → Cancel.
Cancel at least 24 hours before the end of the current period, otherwise the store may charge the next renewal. Cancellation takes effect at the end of the period you have already paid for; until then the plan stays active, and the credits already added to your balance remain yours.
8. Refunds
- Refunds are handled by Apple and Google under their own policies, not ours. We do not receive your payment directly and we cannot issue, force or promise a refund for a store purchase.
- To request one, use reportaproblem.apple.com for App Store purchases, or the Google Play order history / support.google.com/googleplay for Google Play purchases.
- If a purchase is refunded or charged back, we may remove the corresponding credits from your balance, and if the balance would go negative we may suspend the account until it is settled.
- None of this removes rights you have by law. If you believe you are entitled to a refund that the store has refused, write to info@aicatalyst.dev and we will look at it and help where we can.
9. Right of withdrawal (consumers in the EU and EEA)
As a consumer in the European Union or European Economic Area you normally have 14 days to withdraw from a distance contract, without giving a reason.
- Credits are digital content that is supplied immediately: the moment the store confirms your purchase, the credits appear in your balance and the contract is fully performed.
- By buying credits or a subscription you expressly request that we begin performance immediately and you acknowledge that you thereby lose your right of withdrawal in respect of the credits delivered, in accordance with Article 16(m) of Directive 2011/83/EU and Article 17(1)(m) of Decree-Law 24/2014 as amended.
- Where the right of withdrawal still applies, you can exercise it within 14 days by writing to info@aicatalyst.dev, in any clear statement. Because the payment was taken by Apple or Google, the actual refund has to be issued by the store — we will support your request with them.
- Nothing here affects your statutory rights regarding digital content that is not in conformity with the contract.
10. Acceptable use
You agree not to:
- use the App for unlawful, fraudulent, defamatory, harassing, hateful or discriminatory purposes, or in any way that infringes someone else's rights;
- submit content that you have no right to submit, including detailed information about other identifiable people who have not agreed to it;
- use the App to seek or provide medical, legal or financial advice, or to encourage self-harm or harm to others;
- create more than one account per person, or create accounts to obtain welcome credits repeatedly;
- abuse the recommendation programme: recommending addresses you made up, recommending addresses in bulk, recommending an address whose owner would not want to hear from us, or creating accounts in order to recommend yourself;
- try to bypass, falsify or manipulate the credit system, purchase verification or any usage limit;
- reverse-engineer, decompile, tamper with or probe the App or our servers, other than as permitted by mandatory law;
- use bots, scrapers or other automated means to extract content, to generate readings in bulk, or to place unreasonable load on the service;
- resell, sublicense or commercially exploit the App, the readings or the credits without our written permission.
11. Suspension and termination
We may suspend or terminate an account, with immediate effect where necessary, if we reasonably believe it is being used in breach of clause 10, if a purchase is fraudulent or reversed, if the account belongs to someone under 16, or if we are required to do so by law or by an app store. Where the circumstances allow, we will tell you why and give you a chance to put it right, and we will act proportionately — a minor first breach will normally get a warning, not a deletion.
Termination for breach means the loss of any remaining credits, without compensation, except where the law provides otherwise. You may also close your account yourself at any time (clause 4), which likewise forfeits any unused credits.
12. AI-generated content and your content
- Interpretations are produced automatically by third-party artificial-intelligence models. They may be inaccurate, generic, contradictory, or simply wrong, and two identical questions may get different answers. We do not warrant the accuracy, completeness, usefulness or fitness for any purpose of anything a reading says.
- The AI is instructed to remember a small number of personal facts you mention, in order to make later readings feel continuous, and those facts are sent to the AI provider with each reading. This happens automatically, without asking you each time. What is kept, for how long, and how to have it removed is set out in the Privacy Policy. If you would rather it not happen, do not write anything into the App that you would not want stored.
- You keep whatever rights you have in the text you write. You grant us a licence to store and process it, and to transmit it to our AI provider, only so far as needed to run the service.
- You may freely use, copy and share, for your own personal purposes, the text of the readings generated for you.
13. Intellectual property
The App, the Nuvia Horoscope name and logo, the interface design, the chart and icon artwork and all associated software are owned by AI Catalyst, Lda. or its licensors and are protected by intellectual-property law. These Terms grant you nothing more than a personal, limited, non-exclusive, non-transferable and revocable licence to use the App on devices you own or control, for your own non-commercial use.
14. Availability, changes to the service, and communications
- We try to keep the App available, but we do not guarantee uninterrupted or error-free operation. The service depends on third parties — AI providers, the app stores, push-notification services, network operators — and on maintenance windows and events outside our control.
- We may add, change, limit or discontinue features, services or plans. Where a change is significant and to your disadvantage, we will give reasonable notice in the App, and you may cancel a subscription before it takes effect.
- We send transactional emails (address confirmation, password reset, account-deletion code). These emails are sent in the language you chose in the App, and a recommendation invitation is sent in the language of the person who asked us to send it.
- The App may send push notifications reminding you of an unfinished reading or that you have not read for a while. There are no marketing or promotional notifications. Transactional e-mails are sent in the language you chose in the App. The only message we send to someone who is not a user is a recommendation invitation, which goes out once and is never repeated. You can turn notifications off with the switch in the App's settings, or in your device's system settings; the switch applies to that device.
15. Disclaimer of warranties
The App and every reading it produces are provided "as is" and "as available". To the fullest extent permitted by applicable law, we disclaim all warranties, conditions and representations of any kind, whether express, implied or statutory, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, secure or error-free, that defects will be corrected, or that any reading will be accurate, insightful, predictive or true.
Some jurisdictions, including some US states, do not allow the exclusion of certain implied warranties. In those places, the exclusions above apply only as far as the law allows, and you may have warranty rights that this clause cannot take away. Consumers in the EU and EEA keep in full their statutory rights concerning the conformity of digital content and services, which nothing in these Terms limits.
16. Limitation of liability
To the fullest extent permitted by applicable law:
- we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost opportunities or loss of goodwill, however caused;
- we are not liable for any decision you take, or fail to take, on the basis of a reading, or for any outcome you attribute to one — the App is entertainment (clause 2);
- our total aggregate liability arising out of or relating to the App is limited to the greater of (a) the amount you actually paid us, through the app stores, in the 12 months before the event giving rise to the claim, or (b) EUR 50.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for wilful misconduct or gross negligence, or for any other liability that cannot lawfully be excluded — including the mandatory rights of consumers in the EU and EEA. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the limits above may not apply to you in full.
17. Changes to these Terms
We may amend these Terms, for example when features, plans or legal requirements change. The date at the top always shows the current version. Significant changes will be announced in the App with reasonable notice before they take effect. If you continue to use the App after that, you accept the new version; if you do not accept it, stop using the App and, if you wish, delete your account and cancel any subscription in the store.
18. Governing law and disputes
We do not require arbitration and we do not ask you to waive class actions. Disputes go to the courts, as follows.
- Governing law. These Terms and any dispute arising from them are governed by Portuguese law, excluding its conflict-of-law rules.
- Consumers in the EU and EEA. The choice of Portuguese law cannot deprive you of the protection of the mandatory consumer rules of the country where you habitually live (Article 6 of Regulation (EC) 593/2008). You may also bring proceedings against us either in the Portuguese courts or in the courts of your own country of residence, and we may sue you only in the courts of your country of residence (Articles 17 to 19 of Regulation (EU) 1215/2012). Nothing in these Terms changes that.
- Alternative dispute resolution (Portugal and the EU). Before going to court you may refer a consumer dispute to an ADR body. The entity competent for our registered office is CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (www.cniacc.pt). A full list of Portuguese consumer-dispute bodies is at www.consumidor.gov.pt. We are not obliged to take part in ADR, and we will tell you case by case whether we will.
- Residents of the United States. We are a Portuguese company with no offices and no staff in the United States, and our choice of Portuguese law and of the courts of the district of Setúbal is stated honestly as our preference. We recognise that it may not be enforceable against you. Many US states do not permit consumers to waive the protection of their local consumer-protection statutes or their local courts, and a US court may apply its own state's law and hear the case regardless of this clause. Nothing here prevents you from bringing a claim in the small-claims court where you live, or from contacting your state attorney general or another consumer authority.
- Everyone else. Subject to any mandatory rule that says otherwise, the courts of the district of Setúbal, Portugal, have jurisdiction.
- Try us first. Whatever the forum, please write to info@aicatalyst.dev before starting proceedings. Most problems — a purchase that did not credit, a subscription you cannot cancel, a reading that went wrong — are fixed in a day by email.
19. Miscellaneous
- If any provision of these Terms is held invalid or unenforceable, the rest remains in force, and the invalid provision is replaced by the valid one closest to its intent.
- Our not enforcing a provision on one occasion is not a waiver of it.
- You may not transfer your account or your rights under these Terms. We may transfer ours as part of a merger, acquisition or transfer of the business, without reducing your rights.
- These Terms, together with the Privacy Policy, are the whole agreement between you and us regarding the App.

21. Apple App Store
If you obtained the App from the Apple App Store, Apple's Licensed Application End User License Agreement additionally applies to your licence to use the App software. These Terms govern the service itself — credits, subscriptions, readings and your account. Where the two differ as to the software licence on Apple devices, Apple's agreement prevails.
Apple is not a party to these Terms and is not responsible for the App or for its content. Apple has no obligation to provide any support or maintenance for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Any claim relating to the App must be addressed to us, at the contact address above, and not to Apple.
If you obtained the App from Google Play, no equivalent agreement applies and these Terms govern your use in full.
